My two cents:  some mount progs test whether "device" in
   mount [-fnrsvw] [-t vfstype] [-o options] device dir
really exists even if the given filesystem is a nodev filesystem.  You might 
try
   mount -t unionfs -o dirs=... /dev/null /mountpoint
Just a guess.
